Rafa Mir, the former Wolverhampton Wanderers and Sevilla forward, has been sentenced to 8.5 years in prison after being found guilty of sexual assault and battery.
A jury in Valencia delivered the verdict following an incident that took place in September 2024, when Mir was on loan at Valencia, the club where he began his career.
Mir, 28, had consistently protested his innocence throughout the proceedings, publicly stating that his innocence “would be proven in court.”
The incident occurred when Mir returned to his property in the early hours of a Sunday morning alongside two accomplices and two women.
The following day, a 21-year-old woman filed a formal complaint with police, alleging sexual assault had taken place at the property.
The public prosecutor had originally sought a harsher sentence of 10.5 years, covering charges of sexual assault including bodily entry as well as battery.
Mir argued throughout the trial that the encounter had been consensual, but the court ruled against him, determining that consent had not been given by the victim.
The court found that the victim’s testimony satisfied three key requirements needed for the burden of evidence to outweigh the presumption of innocence, including the absence of inexplicable details, the plausibility of her account, and the consistency of her account.
The victim has been awarded damages of €64,000, though Mir retains the right to appeal the verdict following his release on bail after an earlier arrest.
One of Mir’s accomplices that night, Pablo Jara, was also found guilty and handed a separate sentence of 2.5 years in prison alongside a fine of €6,280 for sexual assault.
Mir’s case is among several high-profile sexual assault cases to make headlines across Spain in recent years, drawing significant public and media attention to the issue.
The most prominent prior case involved Brazilian footballer Dani Alves, who was initially convicted of rape before being acquitted on appeal after a two-year stint in prison.
Former Celta Vigo captain Hugo Mallo was also convicted of sexual assault against the Espanyol mascot, adding to a series of cases that have cast a long shadow over Spanish football.
